Personal injury law firm on Long Island
of Jeffrey G. Lerman, P.C. explains New York injury laws
to help people better understand how injury law can impact your legal case.
Car Accident Injuries
Motor vehicle and car accidents are one of the leading causes of personal injuries in Long Island. Traffic on two of our busiest highways, the Long Island Expressway and Southern State Parkway, can lead to driver irresponsibility and aggressive driving. Swerving into lanes, driving while fatigued, driving while intoxicated (DWI), cell phone use, and speeding are reasons car accidents may occur. Although Nassau County and the state of New York have laws enforcing cell phone use and DWI, there are still drivers that do not comply and cause an accident where someone is injured or killed.
New York Workers Compensation Laws
Long Island workplace injuries may be due to construction accidents, slips and falls, defective products, premises liability, electrical problems, and negligent conditions. In March of 2007 the Workers Compensation Reform Act was enacted. This Act has proven to have benefited how workers compensation claims are processed in New York. Some of the highlights of the law are cited in a Joint Report to the Governor prepared by the Superintendent of Insurance of the Workers Compensation Board (http://www.wcb.state.ny.us/content/main/TheBoard/2009DataCollectionReport.pdf) and include:
• Maximum benefits were increased for injured workers;
• Work initiatives;
• Limit on indemnity benefits for non-scheduled claims; and
• Stricter penalties for fraud and workers compensation abuse.
NY Statutes of Limitations
In any injury case, timeliness is critical. New York, as other states, has statutes of limitations which are laws that place a time limit on when personal injury lawsuits can be initiated. For example, cases involving automobile accidents and “slip and fall”, have a three year statute of limitations from the date of the accident.
